These Terms of Service (“Terms”) govern your access to and use of the website spaoneutah.com (the “Site”) and the services, products, memberships, and treatments provided by Spa One (“Spa One,” “we,” “us,” or “our”). By using the Site, booking an appointment, purchasing products or memberships, or receiving services from us, you agree to these Terms. If you do not agree, do not use the Site or our services.

1. Eligibility

You must be at least 18 years old to create an account, purchase memberships, or receive medical aesthetic services from us. Minors may receive certain non-medical services only when accompanied by a parent or legal guardian. Children under age 5 are not permitted in the spa.

2. Services

Spa One offers spa, beauty, and medical aesthetic services, including but not limited to massage, facials, pedicures, injectables, laser treatments, body treatments, and weight loss services. All services are subject to provider availability, your individual health profile, and our professional judgment. We reserve the right to refuse, modify, or discontinue any service at any time.

3. Bookings, Cancellations, and No-Shows

Appointments may be booked through our online booking partner, by phone, or in person. By booking, you agree to our spa policies, including:

Changes made at least one day in advance will not incur a fee.

Same-day cancellations are subject to a 50% fee, up to $50 per person, per treatment hour.

No-shows are subject to a 50% fee, up to $100 per person, per treatment hour.

You authorize us to charge the cancellation or no-show fee to the payment method on file. If you are unwell or experiencing symptoms of illness, please contact us as soon as possible to reschedule. Same-day fees may be waived at our discretion if your slot can be filled with advance notice.

4. Payments and Pricing

All prices are listed in U.S. dollars and are subject to change. We will honor written pricing as stated at the time of booking or promotion, but reserve the right to correct unintentional errors or inaccuracies. You are responsible for paying all charges associated with your account, including service fees, product purchases, taxes, and any cancellation or no-show fees.

5. Memberships

Memberships begin on the date of purchase and automatically renew annually unless cancelled in advance. To maintain membership benefits you must keep an active membership, keep a valid payment method on file, pay any cancellation or no-show fees, and follow spa policies. Full membership terms are available on the Membership page of the Site and are incorporated into these Terms by reference.

6. Gift Cards

Gift cards are redeemable for services and products at Spa One. Gift cards are non-refundable, may not be redeemed for cash except as required by law, and may not be replaced if lost or stolen.

7. Refunds

All sales are final, and we do not offer refunds. If you are unhappy with any aspect of your experience, please let us know during your visit and we will make a reasonable effort to address your concerns. Services are performed to professional industry standards, but specific results are not guaranteed.

8. Medical and Aesthetic Service Disclaimers

Medical aesthetic and wellness services, including injectables, laser treatments, weight loss programs, and skin procedures, involve inherent risks. Before any such service, you will be asked to complete an intake form and review the risks, benefits, alternatives, and post-care instructions with your provider, and to sign a separate informed consent. By receiving services, you represent that you have provided accurate health information and have followed pre-treatment and post-treatment instructions.

Individual results vary and are not guaranteed. The Site and any communications from us are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding your specific health condition.

9. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

10. Acceptable Use

You agree not to use the Site or our services to: (a) violate any law or regulation; (b) infringe the rights of others; (c) interfere with or disrupt the Site or its security; (d) submit false, misleading, or fraudulent information; or (e) attempt to gain unauthorized access to any part of the Site or our systems.

11. Intellectual Property

The Site and its content, including text, graphics, logos, images, and software, are the property of Spa One or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission. Brand names referenced on the Site are the trademarks of their respective owners.

12. Third-Party Services

The Site uses third-party services for functions such as online booking, payments, and analytics, and may link to third-party websites. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is subject to their own terms and privacy policies.

13. Disclaimer of Warranties

THE SITE AND ALL SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SPA ONE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SERVICE WILL ACHIEVE A SPECIFIC RESULT.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPA ONE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, OUR SERVICES, OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations on liability, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Spa One and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site or our services, or your violation of any law or third-party right.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, the Site, or our services will be brought exclusively in the state or federal courts located in Davis County, Utah, and you consent to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top reflects the most recent version. Continued use of the Site or our services after changes are posted means you accept the updated Terms.
